Thank you for visiting www.CLVisual.com (this domain and all pages using such domain, collectively referred to as “Website”) and reviewing our Privacy Policy, which applies to your visit and use of the Website, as well as the CL Visual web app (“App;” Website and App are collectively referred to as “Services”). This Privacy Policy applies only to how CL Visual Inc. (“Company” or “we” or “us”) collects and uses your information, and does not necessarily describe information collection practices on other sites, services, or 3rd parties, including those linked to or from the Services. For all purposes herein, “CL Visual” refers to the Company and its direct affiliates under common ownership and control.

By visiting the Website, creating an account on the Website or App, using the App, or otherwise using our Services, you consent and agree to be bound by this Privacy Policy.

  1. What Type of Information We Collect.

While Visiting the Website

We may contact you by email or other contact information provided by you to respond to inquiries, provide Services you specifically request, or to verify or assist you in updating account information. If you voluntarily provide us your personal information with respect to inquiries, comments, or complaints with respect to our products or services, we will store and/or use that information solely to the extent necessary to respond to you and maintain our relationship with you with respect to your initial correspondence. If you sign up for and consent to our newsletter, we will use your Input Information to send you CL Visual promotional materials via email until you revoke your consent.

Your information is used only by CL Visual and is not shared with any third parties.

The Company is not responsible or liable for any information you provide to third parties, whether through the Website, App, mobile device and/or its operating system, app store, a third-party link or website, social media page, or otherwise. Upon creating an account, you assume the risk that your password is safe from interception or hack attempts by any other third party; you are responsible for ensuring your login information is sufficiently unique and kept safe from other third parties.

For inquiries on how your information is collected and used by third parties, you must visit the privacy policy or send an inquiry to the respective third party. Except as collected via third party apps, as provided herein, if any, or as specifically permitted by you in writing, we do not sell any of your personally identifiable information for any reason.

Mobile Information

No mobile information will be shared with third parties for marketing/promotional purposes. All other sections pertaining to use and sharing of data herein exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Phone numbers we collect, including if voluntarily provided by you, and any consent we receive from you pertaining to your phone number, will not be shared with 3rd party providers.

Mobile information shall be used solely to communicate with you via text message, provided your consent has been collected, and until such consent has expired or been revoked.

Any phone numbers collected with the intended use for SMS/MMS will not be shared with any third parties.

You agree to indemnify, defend and hold harmless the Company and its shareholders, managers, officers, employees, agents and the assigns of same, from and against any and all loss, costs, expenses (including reasonable attorneys' fees and expenses), claims, damages and liabilities related to or associated with your use of the Services, the information you voluntarily provide, and any violation of this Privacy Policy by you. PRIVACY POLICY Addendum FOR CALIFORNIA RESIDENTS

This PRIVACY POLICY ADDENDUM FOR CALIFORNIA RESIDENTS supplements the information in our general Privacy Policy and applies solely to California residents (“California Consumer” or “you”). Any terms defined in the California Consumer Privacy Act of 2018 (“CCPA”), Cal. Civ Code § 1798.100 et. seq. have the same meaning when used in this notice unless defined herein or in the Privacy Policy.

Under CCPA, California residents have the right to know about certain information collected disclosed or sold, the right to opt out of the sale of certain information, and a limited right to have businesses delete information a business has collected about the consumer. These rights extend only to California residents and information covered by CCPA.

Collection, Sharing, and Use of Information

The Privacy Policy available at www.CLVisual.com fully discloses the categories of information we collect about you, how we use it, and whom we share it with. Please review it in full along with this Addendum.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

The CCPA prohibits third parties who purchase the personal information we hold from reselling it unless you have received explicit notice and an opportunity to opt-out of further sales.

Your Rights and Choices

The CCPA provides California residents with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Right to Know Request - You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

We do not provide these access and data portability rights for B2B personal information.

Deletion Request Rights - You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.

  • Debug products to identify and repair errors that impair existing intended functionality.

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

After submitting a request, we will verify your identity by matching the identifying information provided by you to the personal information already maintained by us, or, in cases where your request requires a higher degree of certainty, we may use a third-party identity verification service or ask for a photo ID or for more information. Any information you provide us that is not already in our system will be deleted after your request has been fulfilled.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format- We will strive to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more than 90 days, we will inform you of the reason and extension period in writing.

We will deliver our written response by mail or electronically, depending on how the request was submitted.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Changes to Our Privacy Notice

We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on the Website and update the notice's effective date. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.
